2. INFORMACIÓN Y CONSENTIMIENTO

Al leer esta Política de Privacidad, el Usuario queda informado sobre la forma en que StepsBridge SL recopila, procesa y protege los datos personales proporcionados a través de los formularios disponibles en la Página Web, por terceros con los que hemos firmado acuerdos de colaboración, y recibidos de cualquier otra manera permitida por la ley, junto con cualquier dato relacionado con la navegación y cualquier otra información que pueda ser proporcionada a través de cualquier otro medio o canal. 4. ¿CON QUÉ FIN SE PROCESARÁN LOS DATOS PERSONALES DEL USUARIO Y DURANTE CUÁNTO TIEMPO?

    La base legal para el tratamiento de los datos personales de los Usuarios con este fin puede ser el consentimiento que hayan dado, o puede resultar de la ejecución de una relación contractual o precontractual entre el Usuario y StepsBridge, y/o cualquiera de las futuras filiales de StepsBridge, dependiendo de la naturaleza de la relación y de los medios de comunicación utilizados.

  • Atender consultas, preguntas o solicitudes recibidas de los Usuarios en relación con actividades académicas, otros servicios, eventos, iniciativas y noticias relevantes, o en relación con cualquier otro asunto. La base legal para el tratamiento de los datos personales de los Usuarios con este fin es un interés legítimo en atender y responder a las consultas.

  • Contactar a los Usuarios utilizando cualquiera de los medios indicados anteriormente con el propósito de mantener relaciones y/o continuar con el proceso de admisión y, cuando sea relevante, el proceso de inscripción, o con el fin de organizar la participación en iniciativas. Se informa a los Usuarios que algunas conversaciones pueden ser grabadas, únicamente con el propósito de monitorear las relaciones y el correspondiente proceso de admisión y/o inscripción.


    La base legal para el tratamiento de los datos personales de los Usuarios con este fin puede ser el consentimiento que hayan dado, o puede resultar de la ejecución de una relación contractual o precontractual entre el Usuario y StepsBridge, y/o cualquiera de las futuras filiales de StepsBridge, dependiendo de la naturaleza de la relación y de los medios de comunicación utilizados.

  • Gestionar la inscripción en el evento, programa o iniciativa correspondiente, cuando los Usuarios hayan proporcionado sus datos para este fin.

    Se informa a los Usuarios que StepsBridge, y/o cualquiera de las futuras filiales de StepsBridge, se reservan el derecho de grabar y transmitir cualquier evento o iniciativa que sea organizado por o que involucre a StepsBridge, y/o cualquier filiales futuras de StepsBridge, ya sea en vivo o en una transmisión pregrabada, y de tomar fotografías en tales eventos e iniciativas, y de usar, reproducir, distribuir y comunicar dichas grabaciones y fotos utilizando medios analógicos o digitales, como la Intranet o redes sociales, tanto en España como en el extranjero, con fines académicos o para promover sus actividades o las actividades de los patrocinadores del evento o iniciativa.

  • Gestionar las solicitudes de los Usuarios relacionadas con el ejercicio de sus derechos de protección de datos personales y cualquier otro derecho legal que les pueda corresponder. La base legal para el tratamiento de los datos personales de los Usuarios con este fin es la obligación legal de atender la solicitud correspondiente.

  • Cumplir con cualquier acuerdo de colaboración, convenios, contratos u otros acuerdos firmados por StepsBridge, y/o cualquiera de las futuras filiales de StepsBridge.


    La base legal para el tratamiento de los datos personales con este fin es el cumplimiento de la relación contractual o precontractual en cuestión.

  • Realizar encuestas y clasificaciones.

    La base legal para el tratamiento de los datos personales se llevará a cabo con el fin de mejorar y evaluar la calidad de los cursos ofrecidos con la asistencia de StepsBridge, y/o cualquiera de las futuras filiales de StepsBridge.

  • Mejorar la prestación de servicios y hacer la relación con el Usuario lo más cercana y personalizada posible; así como cualquier otro fin apropiado en relación con los servicios y objetivos de StepsBridge, y/o cualquiera de las futuras filiales de StepsBridge, de conformidad con la ley y de acuerdo con sus intereses legítimos debidamente notificados.

5. ¿QUÉ DATOS DEL USUARIO SERÁN TRATADOS?

StepsBridge, y/o cualquiera de las futuras filiales de StepsBridge, pueden tratar los siguientes tipos de datos del Usuario, dependiendo de la solicitud realizada a través de la Página Web o a través de cualquier otro canal: datos identificativos (incluida imagen y voz) y datos biométricos, datos de contacto, información sobre características personales, información sobre circunstancias sociales, información sobre empleo, datos económicos, financieros y de seguros, y datos de navegación recopilados a través del uso de cookies, como historial de navegación, dirección IP u otra información similar.

En el caso de que los Usuarios proporcionen datos de terceros, declara haber obtenido el consentimiento del tercero en cuestión y se compromete a hacer llegar la información contenida en esta Política de Privacidad, eximiendo a StepsBridge, y/o cualquiera de las futuras filiales de StepsBridge, de cualquier responsabilidad en este sentido. 6. ¿CUÁL ES LA LEGITIMIDAD DEL TRATAMIENTO DE LOS DATOS PERSONALES DEL USUARIO?

Como se ha establecido anteriormente, el tratamiento de los datos del Usuario por parte de StepsBridge, y/o cualquiera de las futuras filiales de StepsBridge se basa en lo siguiente:

  • Consentimiento explícito dado por el Usuario, que puede ser retirado en cualquier momento. Sin embargo, si el Usuario retira su consentimiento, esto no afectará a la legalidad del tratamiento realizado anteriormente;

  • Ejercicio de una relación precontractual o contractual;

  • Prestación de servicios que han sido contratados o que se van a contratar;

  • Cumplimiento de una obligación legal; o

  • Intereses legítimos de StepsBridge, y/o cualquiera de las futuras filiales de StepsBridge.


7. ¿A QUIÉN SE COMUNICARÁN LOS DATOS PERSONALES DEL USUARIO?

Los datos personales de los Usuarios pueden ser comunicados, entre otros, a los siguientes:

  • Administraciones Públicas en los casos previstos por la ley;

  • Personas jurídicas y naturales con las que StepsBridge, y/o cualquiera de las futuras filiales de StepsBridge, hayan firmado acuerdos para la provisión de servicios en los que actúan como responsables de tratamiento o bajo los cuales la cesión de datos es necesaria para el cumplimiento del servicio contratado (proveedores de software y marketing, Compañías de Seguros de Accidentes Mutuos, compañías de seguros, organizaciones de bienestar social, abogados y administradores externos, instituciones educativas, empresas que proporcionan formaciones, hoteles y empresas de transporte para la gestión de viajes, servicios de mensajería, etc.);

  • Instituciones de terceros para la concesión o gestión de ayudas, subvenciones y becas, o cualquier proceso requerido por las autoridades o cuerpos competentes;

  • Los medios de comunicación, redes sociales, sitios web de la industria y empresas de terceros encargadas de grabar mientras se realizan eventos;

  • Bancos e instituciones financieras para la gestión de pagos, solicitudes de asistencia financiera, préstamos, financiación y cualquier otro tipo de servicio;

  • Empresas pertenecientes a StepsBridge, para fines administrativos y de gestión, y cualquier otra que pueda incorporarse en el futuro.

En algunos de estos casos, los datos pueden ser enviados a organizaciones ubicadas fuera del EEE o fuera del grupo de países reconocidos como seguros por la UE, lo que implicaría una transferencia internacional de datos. En ese caso, StepsBridge, y/o cualquiera de las futuras filiales de StepsBridge, implementarán las garantías requeridas para proporcionar un nivel de protección adecuado para los datos personales, como el uso de cláusulas contractuales estándar (por ejemplo, con países como Brasil, Canadá, China, EE.UU., India, Kenia, etc.). 8. RESPONSABILIDAD DEL USUARIO

El Usuario:

  • Garantiza que tiene más de 18 años y que los datos que proporciona a StepsBridge, y/o cualquiera de las futuras filiales de StepsBridge, son verdaderos, precisos, completos y actuales. A tal fin, el Usuario es responsable de la veracidad de los datos facilitados, y deberá asegurarse de que estos datos se mantenga actualizados de tal manera que refleje su situación actual.

  • Garantiza que ha informado a cualquier tercero cuyos datos proporcione, cuando corresponda, del contenido de este documento. Además, garantiza que ha obtenido su autorización para remitir sus datos a StepsBridge, y/o cualquiera de las futuras filiales de StepsBridge, para los fines indicados.


  • Será responsable de cualquier información falsa o inexacta que pueda proporcionar a través de la Página Web y de cualquier daño causado directa o indirectamente a StepsBridge, y/o cualquiera de las futuras filiales de StepsBridge, o a terceros como consecuencia.

9. COMUNICACIONES COMERCIALES Y PROMOCIONALES

Uno de los fines para los que StepsBridge, y/o cualquiera de las futuras filiales de StepsBridge, procesará los datos personales proporcionados por los Usuarios es enviarles comunicaciones electrónicas personalizadas que contengan información relacionada con productos, servicios, eventos, cursos, promociones y noticias que sean relevantes para los Usuarios. 10. EJERCICIO DE DERECHOS

El Usuario puede enviar un aviso escrito a gdrp@educaseeker.com marcado “Protección de datos”, en cualquier momento, acompañado de una fotocopia de su documento de identidad y/o pasaporte, para los fines de:

  • Retirar cualquier consentimiento proporcionado.

  • Obtener confirmación sobre si StepsBridge, y/o cualquiera de las futuras filiales de StepsBridge, están tratando datos personales que afectan al Usuario.

  • Acceder a sus datos personales.

  • Corregir cualquier información inexacta o incompleta.

  • Solicitar que se eliminen sus datos cuando, entre otras razones, sus datos ya no sean necesarios para los fines para los que fueron recogidos.

  • Requerir a StepsBridge, y/o cualquiera de las futuras filiales de StepsBridge, que limiten su tratamiento de los datos cuando se cumpla alguna de las condiciones previstas en la normativa de protección de datos.

  • Oponerse al tratamiento de los datos. En este caso, StepsBridge, y/o cualquiera de las futuras filiales de StepsBridge, cesarán el tratamiento de los datos, a menos que esto sea necesario para fines legítimos obligatorios o para el ejercicio o defensa de

    cualquier posible reclamación.

  • Solicitar la portabilidad de sus datos.

11. MEDIDAS DE SEGURIDAD

Los datos del Usuario serán tratados en todo momento de manera absolutamente confidencial, y se mantendrá el debido secreto en relación con ellos, de conformidad con lo dispuesto en la legislación aplicable. GENERAL TERMS AND CONDITIONS FOR USING THE WWW.EDUCASEEKER.COM WEBSITE

This present General Terms and Conditions regulates the use of the Internet website “https://www.educaseeker.com”, which is made available to you, the user (the “User”), by StepsBridge SL, with registered office in Calle Almenares 42, 46540, Spain and with Tax Code (NIF) B16872558.

Use of this website implies the User’s full acceptance of all the General Terms and Conditions for the Use of the Website that apply at any time that he/she accesses the site. Therefore, if the User does not agree with any of the terms or conditions set out herein, he/she should not use this Website. StepsBridge hereby reserves the right to modify these General Terms and Conditions for the Use of the Website at any time, along with any other general or specific terms and conditions, user regulations, instructions or notices that may be applicable. StepsBridge also hereby reserves the right to suspend, interrupt or cease to operate the Website at any time.

The services offered on the Website are directed towards parties who are resident in Spain. Any individual or organisation that is resident or domiciled in another European Union country or outside the European Union must ensure that access to and use of the Website and/or its contents is permitted under the laws of the country in question. In any case, access to and use of the Website by a User who is in breach of the requirement to be resident in Spain shall be understood to be at the said User’s own exclusive liability, and StepsBridge shall be exempt from any liability to the extent that this is permitted under the legislation in force.

By means of this Website, StepsBridge offers Users access to a range of content, information and data (the “Content”), which is made available by StepsBridge, by third party service and content providers or the rest of entities mentioned above. StepsBridge and the said entities hereby reserve the right to modify the presentation (including the look and feel), layout and location of the Website at any time, along with the Content and the terms and conditions required to make use of it. The said Content includes an area to which access is restricted to Users who have previously registered (the “Registered Users”), access to and use of which is subject to the conditions set out in section 3 of this present document.

Any Users who wish to establish a hyperlink or link between their own website and the Website (the “Link”) must obtain prior authorisation from StepsBridge by sending a request by email to info@educaseeker.com, and they shall be bound to comply with the following obligations: (i) the Link shall only permit access to the Website and may not reproduce it in any way; (ii) Links shall not be established with any page other than the Website’s home page; (iii) no frame or border environment shall be created around the Website; (iv) no false, inaccurate or incorrect statements or indications shall be made in respect of the Website; (v) it shall not be stated or given to be understood that StepsBridge has supervised or in any way accepted the content or services offered or announced on the website on which the Link is shown; (vi) the website on which the Link is shown shall not include any trademark, trading name, establishment signage, business name, logo, slogan or other distinguishing mark belonging to StepsBridge, any other entity of StepsBridge and/or any third party, without their authorisation; (vii) the website on which the Link is shown shall not offer information or content that is illegal or contrary to good morals, generally accepted practices or public order, or that contravenes any third party rights. 3. RESTRICTED ACCESS AREA

In order to access and use the restricted access area, Users must previously have registered as users of EducaSeeker or the corresponding service provider entity and use the passwords provided for this purpose.

Registered Users shall at all times be responsible for the safekeeping of their password, and shall therefore be liable for any damage that may result from its improper use or from its being forwarded, disclosed or mislaid. To this end, access to restricted areas and/or any use of Content that is made using the password belonging to a Registered User shall be understood to have been effected by the said Registered User, who shall be liable in all cases for this access and use. Registered Users may change their passwords at any time by sending a direct request to StepsBridge. In the event that they forget their password, or in any other circumstance involving the risk that the Content may be accessed and/or used by unauthorised third parties, Registered Users must immediately inform StepsBridge so that it may block the password in question and replace it.

4. INTELLECTUAL PROPERTY RIGHTS

The User hereby acknowledges and accepts that all intellectual property rights pertaining to the Website, its source code, design, browser structure, databases, Content and/or any other elements included in the Website (trademarks, logos, trading names, texts, images, graphics, designs, sounds, databases, software, flow charts, presentation, look and feel, audio and video) are the property of StepsBridge and/or third parties.

Under no circumstances shall access to the Website imply any kind of waiver, transfer, licence or grant of the said rights, whether wholly or in part, unless expressly otherwise established. These present General Terms and Conditions for the Use of the Website do not grant Users any right to use, alter, exploit, reproduce, distribute or publicly broadcast the Website and/or its Content other than the rights that are expressly set out for each piece of Content or, in the absence of any such mention, in these General Terms and Conditions. The use or exploitation of any rights in any other way shall be subject to prior express authorisation, specifically granted to this end by StepsBridge or by the third party that owns the rights affected.

5. WRITTEN COMMUNICATIONS

Use of this Website implies User´s acceptance to the reception by electronic means of all or part of the communications. When necessary, we will provide the User the relevant information by email or by posting such information on the Website. For contract purposes, the User agrees to use this electronic means of communication and acknowledges that any contract, notice, information and any other communication sent by electronic means complies with the legal requirements as if it was sent in writing. This clause shall not affect the User´s rights recognized by law.

6. USE OF COOKIES

The User hereby acknowledges and accepts that StepsBridge may use cookies when a User browses its Website. 7. EXCLUSION OF GUARANTEES AND LIABILITY

StepsBridge shall not guarantee the availability and continuity of the Website’s operation or the operation of any other website with which it may have established a link. 8. APPLICABLE LAW AND JURISDICTION

The provision of the Website and these present General Terms and Conditions for the Use of the Website are governed by Spanish law. To the extent permitted in law, the parties hereby agree to submit to the jurisdiction of the Courts and Tribunals of the city of Valencia, and they expressly waive any other jurisdictional right to which they may be entitled.
